Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Athlos mobile application (the “App”) operated by Athlos (“us”, “we”, or “our”).

By downloading, accessing, or using our App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access or use the App.

Age Requirement

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.

Use of the App

Athlos grants you a personal, non-transferable, non-exclusive, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.

Health and Fitness Disclaimer

The App provides fitness and workout suggestions for informational purposes only. You should consult your physician or other health care professional before starting any fitness program. The use of any information provided in this App is solely at your own risk.

We are not a licensed medical care provider and have no expertise in diagnosing, examining, or treating medical conditions of any kind. You acknowledge that you are participating in activities at your own risk and agree to hold Athlos harmless from any injury or health-related issues that may arise.

Account Creation

To use certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account.

Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by Athlos and are protected by international copyright, trademark, and other intellectual property laws.

User Content

Our App may allow you to post, link, store, share and otherwise make available certain information, text, graphics, or other material (“Content”). You are responsible for the Content that you post, including its legality, reliability, and appropriateness.

By posting Content on the App, you grant Athlos a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that Content within the App for the purpose of operating and providing the service. You retain all ownership rights to your Content. This license ends when you delete your Content or your account, except where your Content has been shared with other users who have not deleted it.

Zero Tolerance for Objectionable Content

Athlos has ZERO TOLERANCE for objectionable content or abusive behavior. By using our App, you agree that the following types of content are strictly prohibited:

• Harassment, bullying, or threats against other users
• Hate speech, discriminatory language, or content promoting violence
• Sexually explicit, pornographic, or inappropriate content
• Spam, fake information, or misleading content
• Content that violates intellectual property rights
• Any content that promotes illegal activities
• Personal attacks or targeted harassment

Violation of these terms may result in immediate account suspension or termination without warning. We actively monitor user-generated content and will remove objectionable content and eject users who violate these terms within 24 hours of discovery or report.

Subscriptions

Some parts of the App are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (monthly or annually, as selected). Billing cycles are set on a date corresponding to the commencement of your subscription.

Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. Cancellation will take effect at the end of the current billing period. All purchases are processed by Apple. Refund requests are handled by Apple in accordance with App Store policies.

Payment processing services for Athlos are provided by Apple Inc. and its affiliates (“Apple”) and are subject to the Apple Media Services Terms and Conditions, which includes, without limitation, the Apple Services Terms and Conditions. By agreeing to these Terms, you agree to be bound by the Apple Services Terms and Conditions.

Free Trial

Athlos may, at its sole discretion, offer a subscription with a free trial for a limited period of time. You will not be charged until the free trial period is over. On the last day of the free trial period, unless you canceled your subscription, you will be automatically charged the applicable subscription fee.

Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.

Disclaimer

Your use of the App is at your sole risk. The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied.

Limitation of Liability

In no event shall Athlos, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Nevada, without regard to its conflict of law provisions.
